Theo quy định tại Khoản 6 Điều 32 Thông tư số 38/2015/TT-BTC ngày 25/3/2015 của Bộ Tài chính, nếu vi phạm quy định đưa hàng về bảo quản, ngoài việc bị xử phạt vi phạm hành chính theo quy định của pháp luật, người khai hải quan không được mang hàng về bảo quản:

1. Trong thời gian 01 năm kể từ ngày bị xử phạt về hành vi tự ý phá dỡ niêm phong; tráo đổi hàng hóa, tự ý đưa hàng hóa ra lưu thông, sử dụng; bảo quản hàng hóa không đúng địa điểm đăng ký với cơ quan hải quan.

2. Trong thời gian 06 tháng kể từ ngày bị xử phạt về hành vi vi phạm bị lập biên bản nếu vi phạm quy định về thời hạn nộp kết quả kiểm tra chuyên ngành.

Chi cục Hải quan nơi đăng ký tờ khai có trách nhiệm lập danh sách doanh nghiệp vi phạm không được mang hàng về bảo quản gửi về Cục Hải quan để thông báo áp dụng chung trên toàn quốc.
