What will the new model of quality control and food safety inspection be like?

According to the new model in the Scheme on Reforming the Quality Control Model (QA), food safety inspection of imported goods, imported goods are classified into 5 different inspection processes in the direction of simplification. . This scheme is currently being widely consulted by the General Department of Customs.


The classification is based on the history of quality control and food safety inspection activities carried out by ministries, branches, customs agencies and conformity assessment organizations for goods and their compliance process. law of the business.
The first process, the goods are quality assurance at the ministry (based on the results of conformity certification of the designated conformity certification organization) (branch 1).
For this process, when the enterprises carry out the import procedures at the customs office, there has been a notice that the quality inspection result has met the import requirements granted by the ministry or branch for the import goods lot (the Ministry of Industry issues a notice of the result of the quality inspection). meet import requirements on the basis of inspection of conformity certification of the designated conformity certification organization).
The process of implementing import procedures and quality assurance of enterprises consists of 6 steps: 1, the ministries and branches receive the dossiers of registration for quality inspection of enterprises (together with quality certificates already evaluated by the conformity assessment organization. level). 2, ministries and branches process the quality inspection registration dossier. 3, ministries and branches check the results of conformity assessment, goods labels, conformity marks, regulation marks and accompanying documents, or take samples for testing when necessary (Clause 2, Article 27 of the Law on Quality). Commodity products). 4, ministries, branches inform the results of QA to enterprises. 5, the enterprise submits the result of quality inspection to the customs office for carrying out import procedures. 6, Customs clearance of goods.
The second process, goods are QA at the Customs (based on the results of conformity certification of the designated conformity certification organization) (branch 3).
For this process, when the enterprises carry out the import procedures at the customs office with the regulation conformity certification (there is no notice of the state quality test results for the import goods lot meeting the quality requirements). the amount provided by ministries).
With this process, the Customs office (QA) conducts the quality of imported goods based on the conformity certification results of the designated conformity certification organization; issue the result of QS that meets the import requirements for customs clearance.
The process of carrying out import procedures and quality assurance of enterprises consists of 4 steps as follows: Step 1, the quality inspection agency receives the customs dossier, the dossier of registration for quality inspection of enterprises (together with the quality certificate already issued). issued by the conformity assessment organization) step 2, quality control agencies handle customs documents, at the same time with processing quality registration records; step 3, QA integrates the customs inspection and conformity assessment results, goods labels, standard marks, regulation marks and accompanying documents or take samples for testing when necessary (clause 2 Article 27 of the Law on Product and Goods Quality); step 4, the QIA will announce the results of the QA on the Automated Electronic Clearance System, the national one-stop portal and goods clearance.
According to the draft of the project, with this process, businesses can cut 2 procedures steps compared to the current process (branch 1), including steps: Receive quality inspection results from the Ministry and submit test results. quality inspection from the ministry to the customs office for customs clearance.
In the third process, goods do not have a certificate of conformity (branch 3). For this process, businesses register for quality assurance at the focal point for quality assurance at the border checkpoint (both customs procedures and quality assurance). Quality assurance agencies send requests to the designated testing organizations to conduct the inspection, at the same time, examine the dossiers, examine the results of the inspection organizations, issue notices of the quality assurance results and customs clearance.
With this process, businesses can cut 3 steps of procedures, including Enterprises submit assessment results performed by inspection organizations to quality inspection agencies for re-checking; Ministries and branches shall notify the results of QA to enterprises; Enterprises submit quality control results from the ministries to the customs offices for customs clearance.
In the fourth process, goods are subject to normal inspection (check records) (goods have passed 3 consecutive import requirements by the strict inspection method regardless of the importer) (branch 4) .
This is the proposed quality assurance process based on the regulations on reducing inspection, applying the conversion of inspection method of the Law on Product and Goods Quality, the Law on Food Safety; inheriting good practices in the implementation of Decree 15/2018 / ND-CP (after 3 consecutive inspections, the inspection will be transferred to the normal inspection) (Article 17 of Decree 15/2018 / ND- CP).
Goods subject to common inspection (document inspection only) are goods manufactured by the same manufacturer, having the same origin, have the same name, HS code, and are the same in all respects (e.g. : utility, brand, type, specification, etc.) have been consecutively passed the import requirements three times in a strict inspection (regardless of the importer) in one of the three processes ( 1), (2), (3) of the new model, namely:
Procedure 1: The goods have announced that the result of QI meets the import requirements granted by the Ministry of Industry; the customs office will check the results of the quality meeting the import requirements granted by the ministries and branches for customs clearance.
Procedure 2: Goods with a certificate of conformity (there is no notification of the result of QA meeting import requirements granted by the Ministry of Industry); the customs authority conducts the quality control, issues the result of quality inspection and customs clearance.
Process 3: Goods without the certificate of conformity; the focal point of QA at the border gate shall request the designated assessment organization; quality control agencies implementing the quality assurance, announcing the results of quality assurance and clearance.
For goods that meet the conditions of application of normal inspection methods, which have been put into customs inspection by the automatic customs clearance system of the customs office (only checking documents), the enterprise registration of quality inspection at specialized inspection agencies at the border gate, quality inspection agencies perform document inspection and customs clearance of shipments.
In Procedure 5, the goods subject to inspection reduction (goods that have had 3 consecutive consignments meeting the import requirements by the normal inspection method for each importer) (branch 5).
Similar to process 4, this is the proposed quality assurance process based on the regulations on reducing inspection, applying the conversion of inspection methods of the Law on Product and Goods Quality, the Law on Food Safety; inheriting good practices in the implementation of Decree 15/2018 / ND-CP (after 3 consecutive times within 12 months of normal inspection, they will be transferred to reduced test) (Clause 1, Article 17; 1 Article 19 of Decree 15/2018 / ND-CP).
Goods subject to reduced inspection are goods manufactured by the same manufacturer, having the same origin, having the same name, HS code, and the same in all aspects (for example: utility, current label, strain types, technical specifications ...) have had 3 consecutive import requirements under the normal inspection method for each importer according to the process 4 of the new model.
For goods that meet the conditions to apply the reduced inspection method, which has been put into reduction inspection by the automatic customs clearance system of the customs office, the enterprise shall register for quality inspection at the door inspection agency at the door. At the same time, the export quality control agencies randomly select up to 5% of the total imported lots to apply the reduced inspection method of the preceding 1 year.
