Theo quy định tại Khoản 1, Điều 14, Nghị định số 38/2012/NĐ-CP ngày 25/4/2012 của Chính phủ quy định chi tiết thi hành một số điều của Luật An toàn thực phẩm thì: “Tất cả các loại thực phẩm, nguyên liệu thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm khi nhập khẩu vào Việt Nam phải kiểm tra tại cơ quan kiểm tra nhà nước có thẩm quyền do các Bộ quản lý ngành chỉ định...”. Như vậy, đối với mặt hàng nhập khẩu của Doanh nghiệp, khi nhập khẩu vào Việt Nam phải thực hiện kiểm tra vệ sinh an toàn thực phẩm.

Mặt hàng nguyên liệu nhập khẩu về phục vụ sản xuất thực phẩm chức năng chiết xuất từ mào gà là sản phẩm động vật thuộc đối tượng phải kiểm dịch động vật theo danh mục ban hành kèm theo Quyết định số 45/2005/QĐ-BNNPTNT ngày 25/7/2005 của Bộ Nông nghiệp phát triển và Nông thôn.
