Theo Khoản 1 Điều 69 Thông tư số 38/2015/TT-BTC ngày 25/3/2015 của Bộ Tài chính, căn cứ theo thoả thuận trong hợp đồng gia công và quy định của pháp luật Việt Nam, nguyên liệu, vật tư dư thừa, phế liệu, phế phẩm, máy móc, thiết bị thuê, mượn để gia công được xử lý theo các hình thức sau:

1. Bán, biếu tặng, tiêu huỷ tại thị trường nước ngoài.

2. Nhập khẩu về Việt Nam.

3. Chuyển sang thực hiện hợp đồng gia công khác tại nước ngoài.
