- Which HS code should I use?
- What are the import procedures? Do I need to declare my product's chemicals on the 1-door system?
Reply:
- Caprylyl Glycol sterile product has 1.2 Octanediol, can refer to code 29053900.
- This item is not covered by Decree 113/2017 / ND-CP of the Government dated October 9, 2017, so there is no need to declare chemicals when importing.
- Document of customs procedures when importing shall comply with Clause 5 Article 1 of Circular No. 39/2018 / TT-BTC dated April 20, 2018 of the Ministry of Finance amending and supplementing Clause 2, Article 6 of Circular No. 38 / 2015 / TT-BTC dated March 25, 2015 of the Ministry of Finance.
- In addition, Based on the list of chemicals to be disclosed, amended and supplemented and issued together with Decree No. 26/2011 / ND-CP dated April 8, 2011 of the Government "Amending and supplementing a number of articles of Decree No. 108/2008 / ND-CP dated October 7, 2008 of the Government detailing and guiding the implementation of a number of articles of the Chemical Law ”. Pursuant to the provisions of the Government's Decree No. 187/2013 / ND-CP dated November 20, 2013 "Detailing the implementation of the commercial law on international goods purchase and sale laws and buying agency activities, selling, processing and transit goods with foreign countries ”.
- Accordingly, in addition to sterile products Caprylyl Glycol has 1.2 Octanediol, other chemical products when carrying out import and export procedures must obtain a specialized permit from the Ministry of Industry and Trade.
- Cases of exemption from chemical declaration:
o Chemicals are manufactured and imported for security, defense, response to natural disasters and emergency epidemics
o Chemicals are drug precursors, precursors of explosives, industrial explosives and table chemicals licensed for production and import.
o Chemicals imported under 10kg / time of import. The exemptions mentioned at this point do not apply to chemicals that restrict production or business in the industrial sector.
