The General Department of Customs clearly informs a number of mask export issues

The General Department of Customs has just sent a speeding document to the Government Office to report some issues related to the procedure of exporting masks. In the report, the General Department of Customs asked the Ministry of Health to clarify: whether masks that meet Vietnam Standard TCVN 8389: 2010 but not produced circulation numbers can be exported or not?
Previously, the General Department of Customs received feedback from the Ministry of Industry and Trade on March 30, 2020 in the press on the export of regular masks, which were facing some difficulties from the Customs authorities in the past. process of resolving customs clearance procedures, affecting the production and business activities of the enterprise.
To clarify the problem, the General Department of Customs has reported to the Government Office on the implementation of masks export procedures.
Accordingly, in implementing the Government's Resolution No. 20 / NQ-CP of February 28, 2020, the General Department of Customs issued Official Letter No. 1431 / TCHQ-GSQL of March 9, 2020 directing provincial Customs Departments, city: Carrying out physical inspection of exported consignments declared as non-medical masks (HS code 63079090); compare with the standards of medical masks TCVN 8389-2010 published by the Ministry of Science and Technology to determine the actual goods.
Through physical inspection, if customs officers do not have sufficient grounds to identify goods as masks not used in medical use, they may solicit expertise at the Institute of Medical Equipment and Facilities (the Ministry of Health) or organizations. inspection organizations that fully meet the conditions for medical mask examination as prescribed to determine the category of exported goods.
On March 11, 2020, the Ministry of Health issued Decision No. 868 / QD-BYT, stipulating that the medical mask under the Ministry of Health's export license must meet two conditions: minimum standard meets TCVN 8389-1: 2010; TCVN 8389-2: 2010; TCVN 8389-3: 2010 and had a circulation number.
On March 27, 2020, the Ministry of Health issued Official Letter No. 1657 / BYT-TB-CT proposing, "The Ministry of Finance directs functional units to carry out the procedures for exporting medical masks strictly according to the provisions of the Decree. Decision 20 / NQ-CP of the Government ”.
On March 26, 2020, the Import-Export Department (Ministry of Industry and Trade) issued Official Letter 309 / XNK-CN stating, “Representative of the Ministry of Health said that only masks that meet the above two conditions will be considered as medical masks. Currently, the Ministry of Health has put the database of mask circulation registration on the National Single Window System, the Customs authority can access this System to check ”.
On the customs office's side, through the enterprises' reflection on the process of exporting masks and opinions of the ministries, in order to simplify export procedures, on March 27, 2020, the General Department of Customs issued a dispatch. No. 2012 / TCHQ-GSQL assigns the Risk Management Department, the provincial / municipal Customs Departments to assess risks only select shipments suspected of actual inspection of goods, especially shipments exported by manufacturers. Export is not a manufacturer.
During the physical inspection of goods, customs officers shall directly observe the goods if there are not enough signs according to the medical mask standards of TCVN8389-2010, then carry out customs clearance.
In case of observing signs showing standards but declaring that they are other masks (not medical masks), the assessment samples at the Institute of Medical Equipments and Facilities or inspection organizations fully meet conditions for medical mask assessment according to regulations.
The General Department of Customs said it has directed the local Customs Department to review the customs procedures to ensure convenience; cadres and civil servants who commit violations and cause harassment and harassment, temporarily suspend their work to review their responsibilities.
So far, basically the problems related to the customs inspection of the enterprise's face masks have been resolved, the General Department of Customs has not received any comments reflecting any other problems of the enterprise.
Besides, in order to avoid arising problems, the proposal of the General Department of Customs is in accordance with Article 2 of Decision No. 868 / QD-BYT dated March 11, 2020 of the Ministry of Health and Official Letter No. 309 / XNK- On March 26, 2020 of the Import-Export Department - the Ministry of Industry and Trade, there are only masks meeting the two conditions: Having a minimum standard of TCVN 8389-1: 2010; TCVN 8389-2: 2010; TCVN 8389-3: 2010 and has a circulation number to be considered a medical mask. However, in the Ministry of TCVN 8389-1: 2010 on medical masks published by the Ministry of Science and Technology does not require circulation.
In order to avoid obstacles in the process of carrying out export customs procedures for masked consignments, the General Department of Customs requests the Ministry of Health to clarify: the mask item meets the TCVN 8389: 2010 standard but does not show the retention number.
